ANALISIS YURIDIS TERHADAP PELANGGARAN LALU LINTAS YANG MENIMBULKAN KECELAKAAN BERAKIBAT KEMATIAN (STUDI PENELITIAN POLRESTA BARELANG KOTA BATAM)

Abstract

Juridical Analysis Traffic violations that cause death, violations are the main factors causing accidents that result in injuries or death, Law Number 25 of 2009 concerning Road Transportation Traffic is the main legal basis for this research with how is it applied in the field whether it is effective being obeyed by the community or not yet depending on the legal awareness of each of these people. This study aims to find out about traffic violations that cause accidents resulting in death which must be applied in every traffic activity in order to prosecute the Indonesian people, especially in the Batam City area and to find out the duties and authorities of the Barelang Police, Batam. starting from traffic violations, the driver does not control the vehicle or is not careful, and does not have a SIM, so he does not understand traffic rules and lacks ethics in driving. This writing uses the empirical normative research method, in empirical research it is carried out to obtain primary data, namely by interviewing the Traffic Office or, while normative research is carried out through a study of statutory regulations and scientific writing literature related to the Thesis Title. Then, the data were analyzed using qualitative methods. The results showed that traffic violations that still often occur in the handling of traffic units then the Barelang Police and how these obstacles in the process have been running according to the procedure or during the operation. In intellectual terms, public obedience in obeying these rules is a factor as well as an obstacle but if the offender is potentially prone to causing accidents, then a minor violation will be carried out, then an appeal is given from the officer.
