ANALISIS TINDAK PIDANA TERHADAP PELAKU PENYEBARAN VIDEO ASUSILA DI BATAM (STUDI PENELITIAN DI SUBDIT CYBER DITRESKRIMSUS POLDA KEPRI)

Abstrak

Law enforcement to ensnare perpetrators of distributing immoral videos, basically has a fairly adequate legal umbrella contained in Article 27 of the ITE Law. It is stated that one of the prohibited acts in distributing content is the distribution of immoral content. So ideally a legal instrument is needed that regulates this crime and is able to protect victims of the crime. Departing from the concerns above, to prevent crimes that operate in the field of technology. One example of the Case of an Immoral Video that occurred in Batam City is a warning for the Government to continue to enforce the law against every perpetrator.The problem in this study is How is the Law Enforcement Against Perpetrators of Video Distribution and How is the Implementation and Constraining Factors, and Solutions for Law Enforcement Against Perpetrators of Distributing Immoral Videos. This study uses a descriptive analysis method using a normative approach (legal research) and is supported by empirical research. This is done to obtain primary data obtained through interviews through field research (research).The results of this study explain to enforce criminal acts against perpetrators of the distribution of immoral videos. For the community as a reference or guideline, especially for each victim of the perpetrator of the distribution of immoral videos. To report the incident to the authorities, namely the POLRI cyber crime investigator who specifically handles the case. The government and authorized agencies should continue to make preventive and repressive efforts related to cases of immoral videos that are increasingly rampant amidst the rapid development of technology today, so that similar cases are expected not to recur.It is hoped that the government and legislative bodies will also regulate the detailed creation of immoral videos that are widely distributed on electronic media. The authorized law enforcers should not only ensnare the perpetrators but also those who participate in the distribution of immoral videos. The public is also asked to be careful in using electronic media so that there is no misuse of internet media.
