Abstrak

Working is a right that every Indonesian citizen possesses, protected by the constitution. This constitutional right is essentially part of human rights, inherent to the individual from birth until death. The 1945 Constitution of the Republic of Indonesia (UUD 45) Article 27, paragraph (2) states, "Every Indonesian citizen has the right to work and to a decent livelihood that is humane." This study is an empirical research of a descriptive-analytical nature. The types of data used in this research consist of primary and secondary data, which are analyzed qualitatively to produce descriptive statements that are easily understood by the readers.Based on this research, the legal framework for the protection of Indonesian migrant workers is found in Law Number 18 of 2017, which regulates migrant workers employed by legal entities or individuals, the rights and obligations of Indonesian migrant workers and their families, as well as protection throughout the placement system (before, during, and after employment).The proposed solutions include enhancing education, simplifying legal processes, better resource allocation, and improving cooperation with various stakeholders. This research is expected to provide useful recommendations for migrant worker protection policies and to enhance the effectiveness of the KBRI in protecting the rights of Indonesian migrant workers abroad.
