Abstrak

The use of a medical certificate is part of the administrative mechanism for an employee who cannot work because of illness. The use of a falsified medical certificate, however, may constitute a disciplinary violation and affect the trust underlying the employment relationship. This study aims to analyze the legal regulation of warnings and termination of employment against employees who use falsified medical certificates at PT Royce Enterprise Company, as well as the implementation, obstacles, and solutions applied by the company. The study uses normative and empirical legal research with normative juridical and sociological juridical approaches. Data were obtained through literature study, observation, documentation, and interviews with one Human Resources Department (HRD) representative. The data were analyzed qualitatively by relating field findings to applicable legal provisions and the Company's Regulations. The findings show that the company does not immediately terminate an employee merely on the basis of suspicion. The medical certificate is first verified through a barcode or QR Code and, when necessary, confirmed with the issuing health facility. When falsification is proven, the violation is processed under the Company's Regulations and may result in a third written warning (SP III); termination is considered only when the employment relationship can no longer be maintained. The main obstacles are limited and relate mainly to verification time, differences in employee understanding, and employee responses to sanctions. The company addresses these issues through consistent verification, socialization of company rules, and consistent enforcement.
