ANALISIS YURIDIS PERAN PERLINDUNGAN PEREMPUAN DAN ANAK DALAM PENYELESAIAN NON LITIGASI TINDAK PIDANA ANAK (STUDI PENELITIAN POLRESTA BARELANG)

Abstrak

Settlement of juvenile offenses through non-litigation or deliberation is not new to Indonesia, even customary law in Indonesia doesn’t  differentiate between the settlement of criminal and civil cases, all cases can be resolved deliberately with the aim of getting a balance or restoring the situation. By using the restorative method, the expected result is a reduction in the number of children arrested, detained and sentenced to prison, eliminating the stigma and returning the children to normal human beings so that they are expected to be use in the future. In accordance with the Law on Child Protection and the Role of Protection of Women and Children, basically children must be protected because children have a very high dependence on all child protection providers, namely parents, family, community, government, and the State. Based on the data analysis carried out, it is concluded that the factors that cause the occurrence of a weak family economy are the driving force for children to commit criminal acts, the educational factor is that school is a place of formal education for a child starting from kindergarten, elementary school equivalent, high school first is equal and high school equivalent which aims to teach children to develop their knowledge.
